Privacy Policy, Terms of Service and Policy, Refund and Cancellations Policy
1. Exclusion of Liability
These are the limits of legal liability we may have to you.
TO THE FULLEST EXTENT PERMITTED BY LAW (AND UNLESS Data Center Mart (a brand of IBITS Technology Solutions) HAS ENTERED INTO A SEPARATE WRITTEN AGREEMENT THAT OVERRIDES THIS CONTRACT), IBITS, INCLUDING ITS AFFILIATES, WILL NOT BE LIABLE IN CONNECTION WITH THIS CONTRACT FOR LOST PROFITS OR LOST BUSINESS OPPORTUNITIES, REPUTATION (E.G., OFFENSIVE OR DEFAMATORY STATEMENTS), LOSS OF DATA (E.G., DOWN TIME OR LOSS, USE OF, OR CHANGES TO, YOUR INFORMATION OR CONTENT) OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES.
IBITS AND ITS AFFILIATES WILL NOT BE LIABLE TO YOU IN CONNECTION WITH THIS CONTRACT FOR ANY AMOUNT THAT EXCEEDS (A) THE TOTAL FEES PAID OR PAYABLE BY YOU TO IBITS FOR THE SERVICES DURING THE TERM OF THIS CONTRACT, IF ANY, OR (B) INR 10000.
2. Service Availability
We may change or end any Service or modify our prices prospectively.
We may change, suspend or discontinue any of our Services. We may also modify our prices effective prospectively upon reasonable notice to the extent allowed under the law.
We don’t promise to store or keep showing any information and content that you’ve posted. We are not a storage service. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.
3. Usage and Privacy Policy
To maintain privacy the users are responsible to not divulge personal information on the platform. This is not monitored or controlled by Data Center Mart.
We log usage data when you visit or otherwise use our Services, including our sites, app and platform technology, such as when you view or click on content (e.g., learning video) or ads (on or off our sites and apps), perform a search, install or update one of our mobile apps, share articles or apply for jobs. We use log-ins, cookies, device information and internet protocol (“IP”) addresses to identify you and log your use.
Cookie Policy
We use cookies and similar technologies to recognize you when you visit our Services. If you’re signed into Data Center Mart, these technologies help us show you the right information and personalize your experience in line with your settings. For example, cookies enable Data Center Mart to identify you and verify your account.

4. Governing Law and Dispute Resolution
For users living in India and other countries, You and Data Center Mart (a brand of IBITS Technology Solutions) agree that the laws of India, shall exclusively govern any dispute relating to this Contract and/or the Services. You and Data Center Mart both agree that all claims and disputes can be litigated only in the courts in Chennai Jurisdiction.
5. Copyright Policy
Data Center Mart respects the intellectual property rights of others and desires to offer a platform which contains no content that violates those rights. Our User Agreement requires that information posted by Members be accurate, lawful and not in violation of the rights of third parties. To promote these objectives, Data Center Mart provides a process for submission of complaints concerning content posted by our Members. Our policy and procedures are described and/or referenced in the sections that follow.
Please note that whether or not we disable access to or remove content, Data Center Mart may make a good faith attempt to forward the written notification, including the complainant's contact information, to the Member who posted the content and/or take other reasonable steps to notify the Member that Data Center Mart has received notice of an alleged violation of intellectual property rights or other content violation. It is also our policy, in appropriate circumstances and in our discretion, to disable and/or terminate the accounts of Members, or groups as the case may be, who infringe or repeatedly infringe the rights of others or otherwise post unlawful content.
Please note that any notice or counter-notice you submit must be truthful and must be submitted under penalty of perjury. A false notice or counter-notice may give rise to personal liability. You may therefore want to seek the advice of legal counsel before submitting a notice or a counter-notice.
6. Refund Policy
This refund policy explains our policy regarding the refunds made against purchases on www.datacentermart.com website which is owned by IBITS Technology Solutions and/or its subsidiary(ies) and/or affiliate(s) (collectively referred to as the "Company"). This refund policy forms part and parcel of the Terms of Use for the Services.
As we update, improve and expand the Services, this policy may change, so please refer back to it periodically. By accessing the Company website or this Application or otherwise using the Services, you consent to collection, storage, and use of the personal information you provide (including any changes thereto as provided by you) for any of the services that we offer.
The Company respects the privacy of the users of the Services and is committed to reasonably protecting it in all respects. The information about the user as collected by the Company is: (a) information supplied by users (b) information automatically tracked while navigation (c) information collected from any other source (collectively referred to as Information).
Cancellation and Refund Criteria
Our cancellation and refund policy lasts 7 days. If 7 days have gone by since the purchase, unfortunately, we can't offer you a refund or exchange.
To complete your refund, we require a receipt or proof of purchase.Failure to follow this process may affect your right to a refund.Please raise a refund ticket by creating a support ticket, if the above criteria are met. Our team will get back to you and advise you of the next steps.
